What are surplus funds?

Selling price at auction - delinquent property taxes = surplus funds

Surplus funds also known as tax overages or excess proceeds, are money left over after a property is sold at a foreclosure or tax lien auction.

When a property is auctioned for more than the amount owed in taxes, mortgage debt, or other liens, the extra money— belongs to the previous owner.

After the lien issuer is paid back..

and the property is sold..

the difference BELONGS TO YOU!

How it works

  • Clients are sourced from public county records. From here our team of experts reaches out to potencial claimants to notify them of funds and educate them on the process. If the claimant would like to proceed a Surplus Funds Recovery Agreement is signed. This acts as a contract to protect claimants and contractors. It signifies that we have permission to file a claim on your behalf and retain a 30% finders fee only after you receive your funds. Our services are completely risk free with zero upfront cost!

  • Our team will then work with the county holding the surplus to obtain any documents required for approval. This can include a surplus claim form, probate documents, death certificates and w-4s. The documents required can vary greatly from county to county, our attorneys ensure all requirements are fulfilled and documentation is accurate. From here we will set up an online or in-person notary (if required by the state and/or county) and do a final check before submitting to the state.

  • After documents are accepted by the county, payments are typically sent via check or electronic wire transfer from the county to the claimant who is then invoiced for our services. Some counties may distribute payment to both parties initially. The details for your specific claim are outlined on the Surplus Funds Recovery Agreement Form.
